By accessing or using the Solid Base Container Service website ("Site"), or by purchasing, renting, or modifying containers from us, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Site or use our services.
These Terms constitute a legally binding agreement between you ("User," "Customer," or "You") and Solid Base Container Service ("Company," "We," "Us," or "Our").
All prices displayed on our website are estimates and subject to change without notice. Final pricing will be provided in a written quote based on current market conditions, container availability, and specific modification requirements. Quotes are valid for the period stated in the quote document.
We offer containers in various conditions: New (1-Trip), Used Cargo Worthy, Wind & Water Tight (WWT), and As Is. Each condition is described on our Conditions page. Customers acknowledge that "As Is" containers may have significant cosmetic or structural imperfections and are sold without warranties beyond what is explicitly stated.
Custom modification requests must be approved in writing. Modification timelines are estimates and may vary based on complexity. Any changes to approved modifications may result in additional costs and delays.
We provide delivery services throughout Texas, the Gulf Coast region, and nationwide via third-party carriers. Delivery availability and costs vary by location.
The customer is responsible for providing adequate access to the delivery site. This includes clear pathways, proper ground conditions, and any necessary permits. Additional charges may apply if delivery requires special equipment or if rescheduling is necessary due to site inaccessibility.
Customers must inspect containers upon delivery. Any visible damage or discrepancies must be noted on the delivery receipt before signing. Claims for concealed damage must be reported within 48 hours of delivery.
Payment terms are specified in each invoice or quote. Standard terms include:
We accept major credit cards, wire transfers, and company checks. Returned checks are subject to a $50 processing fee.
Orders may be cancelled within 24 hours of deposit without penalty. After 24 hours, deposits are non-refundable. Once a container has been delivered, no refunds will be issued unless the container does not meet the condition grade specified in the quote.
Cancellation of custom modification orders after materials have been ordered or work has commenced will result in forfeiture of deposit to cover incurred costs.
Rental agreements may be terminated with 30 days written notice. Early termination fees may apply.
New (1-Trip) containers come with a 1-year structural warranty covering manufacturing defects. Cosmetic issues are not covered.
Used Cargo Worthy and Wind & Water Tight containers are guaranteed to be wind and watertight upon delivery. No other warranties, express or implied, apply.
As Is containers are sold "AS IS" and "WITH ALL FAULTS." No warranty of any kind, including fitness for a particular purpose or merchantability, applies.
Modifications are warranted for 90 days against defects in materials and workmanship. This warranty does not cover damage caused by misuse, neglect, or unauthorized alterations.
To the maximum extent permitted by law, Solid Base Container Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the specific container or service giving rise to the claim.
You agree to indemnify, defend, and hold harmless Solid Base Container Service and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Solid Base Container Service and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal or state courts located in Harris County, Texas. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Prior to initiating any legal proceeding, you agree to first attempt to resolve any dispute through informal negotiation with us for at least 30 days.
Our Site may contain links to third-party websites or services that are not owned or controlled by Solid Base Container Service. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites.
By using our Site or services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. If you are using our services on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.
